Scope

These Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their trade, business, or profession.

Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Ebergrund Werke Limited.

By placing the products in our online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you click the order button to accept the offer for the goods in your cart. You will receive a confirmation by email immediately after submitting the order.

Contract Language, Storage of Contract Text

The available language(s) for concluding the contract: German.

We store the contract text and send you the order details and our Terms and Conditions in text form. You can view the contract text in your customer account login.

Delivery Conditions

We deliver free of shipping costs.

We only deliver by mail order. Unfortunately, self-collection of the goods is not possible.

We do not deliver to packing stations.

Payment

The following payment methods are generally available in our shop:

Credit Card

During the order process, you provide your credit card details. Your card will be charged immediately after placing the order.

SEPA Direct Debit

By placing the order, you grant us a SEPA direct debit mandate. We will inform you of the date of the debit at least one banking day in advance (known as prenotification). The debit will be made before the goods are shipped.

PayPal

To pay the invoice amount via PayPal, you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment order. The payment transaction will be carried out by PayPal immediately after placing the order.

giropay / paydirekt

In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M. (“giropay” or “paydirekt”), we offer the payment methods giropay and paydirekt.

giropay: To pay using giropay, you must have a bank account enabled for online banking, authenticate accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order.

paydirekt: To pay using paydirekt, you must have a bank account enabled for online banking, be registered with paydirekt, authenticate with your login details, and confirm the payment instruction. The payment will be made immediately after placing the order.

Warranty and Guarantees

6.1 Statutory Warranty Rights

The statutory rights for liability for defects apply.

6.2 Guarantees and Customer Service

Information about any applicable additional guarantees and their specific conditions can be found with the product and on special information pages in the online shop.

Liability

We are liable without limitation for claims due to damages caused by us, our legal representatives, or agents:

in the event of injury to life, body, or health,
in case of intentional or grossly negligent breach of duty,
for warranty commitments, if agreed, or
insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations due to slight negligence, liability is limited to the foreseeable damage typical for the contract at the time of conclusion.

Otherwise, claims for damages are excluded.
